I am disappointed that you voted this week for the so-called “Child Custody Protection Act.” This act makes it a crime for a relative or clergy member to transport a minor across state lines to obtain an abortion, without first complying with the state’s parental involvement requirement (notification or consent). Transporting a minor across state lines to obtain an abortion will be punishable by up to 1 year in prison and a fine of $10,000. This law not only enforces parental notification requirements, but it also enforces parental consent requirements. On Sunday, July 30, 2006, you stated, in person, to Orlando NOW President, Jenna Cawley that you believed this act only enforced parental notification requirements and that you, as a supporter of a woman’s right to choose, oppose parental consent laws. You further stated that Ms. Cawley should “go back and read the law again.” Section 2431 of the CCPA states: `(a) Offense- `(1) GENERALLY- Except as provided in subsection (b), whoever knowingly transports a minor across a State line, with the intent that such minor obtain an abortion, and thereby in fact abridges the right of a parent under a law requiring parental involvement in a minor's abortion decision, in force in the State where the minor resides, shall be fined under this title or imprisoned not more than one year, or both. `(2) DEFINITION- For the purposes of this subsection, an abridgement of the right of a parent occurs if an abortion is performed on the minor, in a State other than the State where the minor resides, without the parental consent or notification, or the judicial authorization, that would have been required by that law had the abortion been performed in the State where the minor resides. It seems clear to me that you voted for this act mistakenly since you stated that you oppose parental consent for abortion requirements and that you believed the CCPA only enforces parental notification requirements. Because of this, I am asking, that you apologize publicly to your constituents for voting for the CCPA. I further ask that you promise to your constituents that you will uphold a woman’s right to choose when given another chance. Sincerely,
